Welcome to LeafStack. The terms โ€œweโ€, โ€œusโ€ and โ€œourโ€ refer to LeafStack. These Terms of Service (โ€œTermsโ€) govern your access to and use of leafstack.in and any related websites, mobile apps, or services we operate (collectively, the โ€œServicesโ€). LeafStack is powered by Shopify for e-commerce functionality.

Please read these Terms carefully. By accessing or using our Services, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. Eligibility & Accounts

  • By using the Services you represent that you are at least 18 years old (the age of majority in India) or that you have the consent of a parent/guardian to use the Services.

  • You agree to provide true, accurate, current and complete information when creating an account or placing an order, and to keep that information up to date.

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may not transfer or assign your account.

2. Our Products & Descriptions

  • We attempt to be as accurate as possible in product descriptions, images and pricing. However, we cannot guarantee that product descriptions, colors or other content are 100% accurate on every device.

  • All product descriptions, specifications and availability are subject to change without notice. We may limit the quantity of any item we offer, and we may refuse or cancel any order for any reason (including errors in pricing or descriptions).

3. Orders, Acceptance & Payment

  • Placing an order on the site is an offer to purchase. Acceptance of your order and completion of the contract between you and LeafStack occurs when we send an order confirmation email.

  • We must receive and successfully process your payment before we accept an order. Payment processing is provided by third-party payment processors (for example, Cashfree). By using such payment services, you agree to their terms.

  • If we do not accept your order, we will notify you and refund any amounts already charged. We are not liable for payment processing failures caused by third-party services.

4. Pricing, Taxes & Billing

  • The price displayed at checkout is the price you will pay, plus any shipping charges and taxes as applicable. Prices and offers are subject to change without notice.

  • You are responsible for any applicable duties, taxes or import fees for orders shipped outside the sellerโ€™s state. For domestic deliveries in India, applicable GST will be shown at checkout where required.

5. Shipping & Delivery

  • Shipping estimates are provided on the product or checkout page. These are estimates only; actual delivery times may vary. We are not liable for delays caused by courier partners, natural events, customs, or other events beyond our control.

  • Title and risk of loss transfer to you upon delivery to the carrier, unless otherwise required by applicable law.

6. Returns, Refunds & Cancellations

  • Our Returns & Refund Policy governs cancellations, returns and refunds. Please review that policy for the full process and timelines.

  • Orders may be cancelled before shipment. Once shipped, orders cannot be cancelled; they may instead be returned per the Returns Policy.

7. Intellectual Property

  • All content on the Services โ€” including logos, text, images, product photos, design and code โ€” is owned or licensed by LeafStack and is protected by copyright, trademark and other laws. You may not use our intellectual property without our prior written consent.

  • If you submit any Feedback to us (reviews, suggestions, ideas), you grant LeafStack a perpetual, worldwide, royalty-free license to use, modify and exploit that Feedback.

8. Third-Party Tools & Links

  • Our Services may contain links to third-party websites, merchants or services (such as payment processors, shipping aggregators). We are not responsible for their content, privacy practices or performance. Your transactions with third parties are solely between you and that third party.

9. Relationship with Shopify & Payment Processors

  • LeafStack uses Shopify to host and operate this store. Shopify does not assume responsibility for the fulfillment, refund or quality of products sold by LeafStack.

  • We use third-party payment processors (such as Cashfree) to accept payments. By paying on this site you agree to the terms of those payment processors. LeafStack is not responsible for any failures, delays or errors that occur on those payment platforms.

10. User Conduct & Prohibited Uses

  • You agree not to use the Services for illegal purposes or to upload harmful, infringing or malicious content. We reserve the right to suspend or terminate accounts that violate these Terms.

11. Disclaimers & Warranty

  • TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED โ€œAS ISโ€ AND โ€œAS AVAILABLEโ€. LEAFSTACK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, EXCEPT AS REQUIRED BY LAW.

12. Limitation of Liability

  • TO THE EXTENT PERMITTED BY LAW, LEAFSTACK AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR PURCHASE OF PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY SHALL BE LIMITED TO THE AMOUNT PAID BY YOU FOR THE RELEVANT ORDER.

13. Indemnification

  • You agree to indemnify and hold LeafStack harmless from any claim, loss, damage, liability or expense (including reasonable legal fees) arising from your breach of these Terms, your violation of law, or your use of the Services.

14. Termination

  • We may suspend or terminate your access to the Services at our discretion for violations of these Terms or for other legitimate reasons. Sections that by their nature should survive termination (intellectual property, indemnity, limitation of liability, etc.) will remain in force.

15. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Delhi / New Delhi, India.

16. Changes to Terms

  • We may modify these Terms at any time by posting an updated version on the Services. Material changes will be communicated via email or a notice on the site. Continued use of the Services after publication of changes constitutes acceptance.
